Rhythmic Gifts provides a custom personalized song creation service. Based on the details, stories, and preferences you provide, we create original songs tailored to your specifications. Each song is a unique creative work produced specifically for you.

2. User Responsibilities

• Provide accurate, complete, and truthful information when placing an order.

• Ensure that all content you submit (including stories, names, and details) is appropriate and does not contain unlawful, defamatory, obscene, or otherwise objectionable material.

• Not request songs that promote hatred, violence, illegal activity, or infringe upon the rights of any third party.

• Not use our Service for any fraudulent or unauthorized purpose.

• Be at least 18 years of age, or have the consent of a parent or legal guardian, to place an order.

We reserve the right to refuse or cancel any order at our sole discretion if we determine the content requested is inappropriate, offensive, or otherwise in violation of these Terms.

3. Intellectual Property

All songs created by Rhythmic Gifts are original creative works. We retain all ownership rights, copyright, and intellectual property rights in and to the songs we produce. Upon full payment, we grant you a non-exclusive, non-transferable, perpetual license to use the song for personal, non-commercial purposes. This includes playing, sharing with friends and family, and using the song for personal events and celebrations.

You may not reproduce, distribute, publicly perform, sublicense, sell, or commercially exploit any song created by Rhythmic Gifts without our prior written consent. If you wish to use a song for commercial purposes, please contact us to discuss licensing options.

4. Payment Terms

• All prices are displayed on our website and are subject to change without prior notice.

• Payment is required in full at the time of order placement unless otherwise stated.

• We accept payment through the methods listed on our website. All payments are processed by third-party payment processors.

• You are responsible for any applicable taxes, fees, or charges associated with your purchase.

• If a payment fails or is disputed, we reserve the right to suspend or cancel your order until the matter is resolved.

5. Delivery Timelines

We strive to deliver your custom song within the estimated timeframe provided at the time of order. However, delivery dates are approximate and provided on a best-effort basis. We do not guarantee exact delivery dates. Factors such as order volume, complexity of the request, and revision requests may affect delivery times.

Rush delivery options, when available, are subject to additional fees and are still provided on a best-effort basis. We will communicate with you if there are any anticipated delays with your order.

6. Revisions

We want you to love your song. If you are not fully satisfied with the initial delivery, we offer revisions as outlined in our Refund Policy. Revision requests must be specific and clearly communicated. We reserve the right to limit the scope and number of revisions at our reasonable discretion to prevent misuse of the revision process.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Rhythmic Gifts and its owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Service, including but not limited to loss of profits, data, or goodwill.

Our total liability to you for any claim arising from or related to our Service shall not exceed the amount you paid for the specific order giving rise to the claim. Our Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, except as required by applicable law.

If we are unable to resolve the dispute informally within thirty (30) days, you agree that any remaining dispute, controversy, or claim shall be resolved through binding arbitration, rather than in court, except that either party may seek equitable relief in court for infringement or misuse of intellectual property rights. The arbitration shall be conducted in accordance with applicable arbitration rules and shall be conducted on an individual basis. Class actions and class arbitrations are not permitted.
